Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between you and ECHO Mental Performance LLC ("ECHO," "we," "us," or "our"). They apply to our website, sessions, assessments, and products (the "Services"). By using the Services or booking a session, you agree to these Terms. If you are under 18, your parent or guardian must agree to these Terms for you.
1. What we do (and what we don't)
ECHO provides mental performance consulting. We help athletes, coaches, and teams build mental skills like focus, confidence, resilience, and handling pressure.
Mental performance consulting is not therapy, counseling, or medical care. We do not diagnose or treat mental health conditions. If you are dealing with a mental health concern, please reach out to a licensed mental health professional. If you are in crisis, call or text 988 or call 911. If we believe you would benefit from clinical support, we may refer you to a licensed professional.
We are not an emergency service. Texts, messages, and emails between sessions are not monitored 24/7. We reply as soon as we reasonably can during regular business hours.
2. Booking and sessions
Sessions can be booked through our website or by contacting us directly.
Sessions may happen in person, by phone, or by video.
You are responsible for having a stable internet connection and a private space for online sessions.
Athletes under 18 need a signed working agreement and confidentiality agreement from a parent or guardian before the first session.
Team and organization work. When we work with a team, the whole team is the client. The head coach or organization has full access to what happens in team sessions. If an athlete on that team also works with us one on one, the confidentiality rules in our Privacy Policy apply to those individual sessions, and we will agree in writing on what, if anything, is shared with the team.
3. Payments
Session fees and package prices are shared with you directly.
Payment is due at the start of each package.
Payments are processed through third party providers like Stripe and Found.
Prices may change, but changes will not affect sessions or packages you already paid for.
4. Cancellations, rescheduling, and refunds
Please give at least 24 hours notice to cancel or reschedule.
Late cancellations or no shows may be charged the full session fee.
If we need to cancel, we will reschedule at no cost or refund that session.
Package sessions must be used within 6 months of purchase.
Paid sessions and packages are non refundable, except as stated above.
5. Results
Mental performance work takes effort and consistency, and everyone's journey is different. We cannot guarantee specific results, like a better score, a starting spot, a scholarship, or a win. What you get out of the process depends also on what you put in.
6. Your responsibilities
You agree to give accurate information, show up ready to work, and treat our sessions with respect. Neither you nor ECHO will record a session without everyone's consent, as Florida law requires.
When using our website or online materials, you agree to use them only for lawful, personal purposes. You may not try to hack, disrupt, or copy the site, use bots or scripts to pull content from it, or share any login or access we give you with someone else.
7. Our content
Everything on our website and in our materials (including the ECHO name and logo, the 1% Journal, worksheets, exercises, and assessments) belongs to ECHO. You can use them for your own personal development. You may not copy, sell, share, or republish them without our written permission.
8. Health and safety
You are responsible for your own physical and mental health decisions. If any activity or exercise we suggest feels unsafe or uncomfortable, stop and let us know.
9. Privacy
Our Privacy Policy explains how we collect and use your information, and it is part of these Terms. Please keep in mind that no email, message, or online platform is 100% private or secure.
10. Disclaimer of warranties
You use the Services at your own risk. Our website, materials, and Services are provided "as is" and "as available." To the fullest extent allowed by law, ECHO does not make any promises or warranties beyond what is written in these Terms. This includes any implied promise that the Services will meet your specific needs, be error free, or always be available. Some laws do not allow these exclusions, so they apply to you only as far as the law allows.
11. Limitation of liability
To the fullest extent allowed by law, ECHO is not responsible for any indirect, incidental, or consequential damages that come from using the Services. If ECHO is ever found responsible for anything, our total liability is limited to the amount you paid us in the 3 months before the claim.
Nothing in these Terms limits ECHO's responsibility for gross negligence, intentional misconduct, or any rights that cannot be waived under Florida law.
12. Indemnity
If you are an adult client and someone else brings a claim against ECHO because you broke these Terms or misused our materials, you agree to cover ECHO's reasonable costs from that claim, including attorney fees.
13. Third party tools and links
We use outside platforms for booking, payments, and video calls, and our site may link to other websites. We are not responsible for how those platforms work or for their content.
14. Ending our work together
You can stop working with us at any time. We may also end our work together if these Terms are not followed, or if we believe another professional would serve you better. In that case, we will try to help with a referral.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida. If a problem comes up, we both agree to first try to work it out directly and in good faith. If we cannot solve it within 30 days, either of us may ask for mediation. If mediation does not work, any case will be handled in the state or federal courts in Miami-Dade County, Florida. Any claim must be brought within one year after it comes up. Where the law allows, claims can only be brought individually, not as part of a class action or group lawsuit.
16. General
You may not transfer your rights under these Terms to anyone else.
If any part of these Terms is found invalid, the rest still applies.
If we do not enforce part of these Terms right away, we still keep the right to enforce it later.
These Terms, our Privacy Policy, and any signed working agreement or confidentiality agreement make up the full agreement between you and ECHO. If a signed agreement says something different from these Terms, the signed agreement wins.
If we provide these Terms in Spanish or another language, the English version controls.
17. Changes to these Terms
We may update these Terms from time to time. We will change the effective date at the top when we do, and email current clients about important changes. Changes will not apply to a package you already paid for. If you keep using the Services after an update, it means you accept the new version.
