ECHO Mental Performance LLC ("ECHO," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to our website echomentalperformance.com, our coaching and consulting sessions (in person and online), our assessments, and our products like the 1% Journal (together, the "Services").

By using the Services, you agree to this Policy. If you do not agree, please do not use the Services.

1. Information we collect

Information you give us. When you book a session, fill out an intake form or assessment, contact us, sign up for updates, or buy a product, we may collect your name, email, phone number, age, sport, team or school, and anything else you choose to share. For athletes under 18, we also collect the parent or guardian's name and contact information.

Session information. During our work together, we may keep notes about your goals, progress, and the mental skills we work on. These notes are used only to support your development and are treated as confidential (see Section 4).

Payment information. Payments are handled by third party processors such as Stripe and Found. We do not store your full card number on our systems.

Information collected automatically. Like most websites, our site may collect basic technical data such as your browser type, device, IP address, pages visited, and time spent on the site. This is done through cookies and similar tools, mostly through our website platform Squarespace and analytics services like Google Analytics.

2. How we use your information

We use your information to:

  • Schedule and deliver sessions and respond to your messages

  • Build a mental performance plan that fits you

  • Process payments and send receipts

  • Send updates, resources, or offers if you opted in (you can unsubscribe anytime)

  • Improve our website and Services

  • Meet legal requirements and protect the safety of our clients and others

3. How we share your information

We do not sell your personal information. Ever.

We only share information in these situations:

  • Service providers that help us run the business, such as our scheduling tool, payment processor, email platform, and website host. They only get what they need to do their job.

  • Parents or guardians of athletes under 18, as described in our working agreement.

  • Coaches, teams, or organizations only when you (or your parent or guardian) give written permission, or as part of team work described in Section 4.

  • Legal reasons, when required by law, a court order, or when we believe someone is at risk of serious harm.

  • Business changes, if ECHO is ever merged, sold, or restructured. Your information would stay protected under this Policy.

Photos, videos, and testimonials. We never post a client's name, photo, video, or story on our website or social media without written consent. For athletes under 18, that consent must come from a parent or guardian. You can take back your consent at any time.

4. Confidentiality of our work together

What you share in sessions stays between us, with a few exceptions explained below.

What parents and guardians are told. For athletes under 18, parents or guardians receive general updates on progress, goals, and the skills we are working on, as agreed in the working agreement and confidentiality agreement. The specific details an athlete shares in sessions stay private, so they can speak openly. The exception is safety. If an athlete under 18 shares something that suggests a risk of harm to themselves or others, we will tell the parent or guardian right away.

Team work. When we work with a team, the whole team is the client. The head coach or organization has full access to what happens in team sessions. If an athlete on that team also works with us one on one, those individual sessions follow the confidentiality rules in this section, and we will agree in writing on what, if anything, is shared with the team.

When we must share information. We may need to share information if there is a risk of harm to yourself or others, if we suspect abuse or neglect of a minor or vulnerable adult (Florida law requires us to report this), or if a court orders it.

Session notes are not legally privileged. Mental performance consulting is not licensed therapy. That means our notes and conversations do not have the same legal protection as communications with a licensed therapist or doctor, and a court could request them in a legal case. If that ever happens, we will share only what is required and let you know when the law allows.

5. Children's privacy

We work with youth athletes, so we take this seriously. We do not knowingly collect personal information from anyone under 13 without a parent or guardian's consent. All athletes under 18 must have a parent or guardian sign our working agreement and confidentiality agreement before sessions begin. If you believe a child under 13 shared information with us without consent, contact us and we will delete it.

6. How long we keep your information

We keep your information only as long as we need it to provide the Services, keep proper records, or meet legal requirements. Session notes are kept for up to 7 years after our last session and then securely deleted. Notes can also be deleted sooner upon written request from the athlete, or from a parent or guardian for athletes under 18.

7. How we protect your information

We use reasonable steps to protect your information, like password protected accounts and trusted, secure platforms. No system is 100% secure, so we cannot guarantee absolute security, but we take it seriously.

If a data breach ever affects your personal information, we will notify you within 30 days, as Florida law requires.

8. Your rights and choices

You can ask us to:

  • See the information we have about you

  • Correct anything that is wrong or out of date

  • Delete your information (unless we are required to keep it)

  • Stop sending you marketing emails

You can also set your browser to block or delete cookies. Some parts of the site may not work as well if you do. To make a request, email us at the address below. We may ask you to confirm your identity first.

9. Links to other websites

Our site may link to other websites or social media like Instagram. We are not responsible for their privacy practices, so please check their policies.

10. Changes to this Policy

We may update this Policy from time to time. When we do, we will change the effective date at the top. For important changes, we will also email current clients. If you keep using the Services after an update, it means you accept the new version.
